Endangered and Threatened Species and Critical Habitat Protection under EPA's Pesticide General Permit

Consistent with Section 7 of the Endangered Species Act (ESA), EPA consulted with the National Marine Fisheries Service (NMFS) and the Fish and Wildlife Service (FWS) to ensure that discharges and discharge-related activities covered under the Pesticide General Permit are not likely to adversely affect species that are federally- listed as endangered or threatened (“listed”) or habitat that is federally-designated as critical (“critical habitat”), except as otherwise provided in the PGP. To demonstrate eligibility for PGP coverage, Operators must meet one or more of the six criteria, identified in Part 1.1.2.4 (PDF) (175 pp, 1.33MB) of the PGP, for the entire term of coverage under the permit. The six criteria are based on protection of NMFS Listed Resources of Concern specific to EPA’s PGP. NMFS Listed Resources of Concern – federally-listed endangered and threatened species and federally-listed critical habitat for which NMFS’ 2011 Endangered Species Act Section 7 Consultation Biological Opinion Exit EPA Site on the U.S. Environmental Protection Agency’s Proposed Pesticides General Permit concluded the final permit, absent any additional mitigating measures, would either jeopardize the continued existence of such species or destroys or adversely modify such critical habitat.

As described in Step One of the Endangered Species Procedures in Appendix I of the PGP, Operators must determine whether any discharges from pesticide application activities overlap directly with any NMFS Listed Resources of Concern. Where those discharges overlap with NMFS Listed Resources of Concern, Decision-makers are required to submit an NOI certifying eligibility under one of the six criteria in Part 1.1.2.4 of the PGP. Following is a state-by-state guide for those areas covered under EPA’s PGP showing where PGP areas of coverage overlap with NMFS Listed Resources of Concern. To use this table, you may need to know the name of the stream(s) into which you will be discharging. Maps of the four states with significant areas that contain NMFS Listed Resources of Concern are provided, highlighting those areas with NMFS Listed Resources of Concern. For discharges in those areas, Operators can view and search the NMFS Listed Resources of Concern information by county and watershed and in some instances, by stream name.
