  • Application of Pesticides to Waters of the United States in Compliance with FIFRA; Final Rule
    A new rule clarifies that a NPDES permit will not be required when application of a particular pesticide to or over, including near, waters of the United States is consistent with requirements of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). The rule identifies two specific circumstances where NPDES permits are not required: the application of pesticides directly to water in order to control pests; and the application of pesticides to control pests that are present over or near water, where a portion of the pesticides will unavoidably be deposited to the water in order to target the pests.

  • Concentrated Animal Feeding Operations Final Rulemaking: Date Extension
    This final rule revises dates established in the 2003 CAFO rule, and later modified in February 2006, by which facilities newly defined as CAFOs are required to seek permit coverage and by which all permitted CAFOs are required to develop and implement NMPs.

    EPA proposes to extends certain compliance dates in the National Pollutant Discharge Elimination System (NPDES) permitting requirements and Effluent Limitations Guidelines (ELGs) for concentrated animal feeding operations (CAFOs).   • National Pollutant Discharge Elimination System Permit Regulation and Effluent Limitation Guidelines and Standards for Concentrated Animal Feeding Operations (CAFOs); Final Rule (2003)
    Revises and clarifies the Environmental Protection Agency's (EPA) regulatory requirements for concentrated animal feeding operations (CAFOs) under the Clean Water Act. This final rule will ensure that CAFOs take appropriate actions to manage manure effectively in order to protect the nation's water quality. The rule revises two sections of the Code of Federal Regulations (CFR), the National Pollutant Discharge Elimination System (NPDES) permitting requirements for CAFOs (Sec. 122) and the Effluent Limitations Guidelines and Standards (ELGs) for CAFOs (Sec. 412) (EPA-821-03-001).

    Under the Federal Water Pollution Control Act (Clean Water Act or CWA), EPA is revising the National Pollutant Discharge Elimination System (NPDES) permitting requirements and Effluent Limitations Guidelines and Standards (ELGs) for concentrated animal feeding operations (CAFOs) in response to the order issued by the U.S. Court of Appeals for the Second Circuit in Waterkeeper Alliance et al. v. EPA, 399 F.3d 486 (2d Cir. 2005). This final rule responds to the court order while furthering the statutory goal of restoring and maintaining the nation’s water quality by ensuring that CAFOs properly manage manure generated by their operations.
